These Terms of Service govern the use of Lexense digital services, provided by Consulting Wojciech Bajer, registered at: ul. 1. General Provisions
1. These Terms of Service govern the use of Lexense digital services, provided by Consulting Wojciech Bajer, registered at: ul. Kokota 23, 41-400 Mysłowice, Silesian Voivodeship, Poland, NIP (Tax ID): 2220919309, REGON: 388306534, contact email: support@lexense.ai. 2. Lexense Services are available through: the Lexense website and web application, the Lexense mobile application (iOS/Android), and the Lexense browser extension for Google Docs. 3. These Terms constitute terms of service for electronic service provision. 4. Use of the Services constitutes acceptance of these Terms.
2. Definitions
1. Service — Lexense functionalities, including document analysis, AI chat, case management, OCR, premium features, and additional features. 2. User — a natural person or entity using the Services. 3. Account — the User's individual profile enabling access to the Services. 4. User Content — data and files submitted by the User, including documents, messages, profile data, and other materials. 5. Paid Plan / Subscription — paid access to extended Lexense features.
3. Scope and Nature of Services
1. Lexense provides tools supporting document analysis and working with legal content. 2. Lexense is informational and supportive in nature. 3. Lexense does not provide legal assistance as defined by legal profession regulations and does not replace consultation with a licensed attorney. 4. Results generated by AI models are automated and may contain errors, inaccuracies, or outdated information.
4. Technical Requirements
1. To use the Services, you need: a device with internet access, a current web browser or current version of the mobile application, and an active email account. 2. Some features may require additional device permissions or external accounts (e.g., Google, Apple). 3. The Provider is not liable for failure to meet technical requirements on the User's side.
5. User Account
1. Creating an Account requires providing accurate data. 2. The User is responsible for the security of login credentials and activity on the Account. 3. The Provider may refuse registration or restrict access in case of violation of law or these Terms. 4. The User may delete their Account in accordance with the procedures described in the application and the Privacy Policy.
6. Acceptable Use and Prohibitions
1. The User agrees to use the Services in accordance with the law, these Terms, and good practices. 2. The following are prohibited in particular: - uploading content without legal basis for disposing of such content, - uploading unlawful content, content infringing personal rights or copyrights, or content belonging to third parties, - attempting to bypass security measures, automated API abuse, or destabilizing the Services, - using the Services for purposes contrary to law.
7. User Content and Ownership Rights
1. The User retains rights to User Content. 2. The User grants the Provider a non-exclusive license necessary to perform the Services, including processing, storing, and analyzing User Content. 3. The license is valid for the time necessary to provide the Services and fulfill the Provider's legal obligations. 4. Rights to Lexense software, interface, trademarks, and materials belong to the Provider or authorized entities.
8. Plans, Fees, and Subscriptions
1. Lexense may offer a free plan and paid plans. 2. Feature scope and limits depend on the selected plan and are published in the application or pricing page. 3. Billing, renewal, cancellation, and refund rules are specified in the Lexense Subscription Terms.
9. Liability
1. The Provider exercises due diligence to ensure the Services function properly, taking into account technological limitations. 2. The Provider is not liable for: decisions made solely based on AI results, consequences of providing false data by the User, unavailability of Services due to force majeure, failures of external providers, or User actions. 3. The Provider's liability to non-consumer Users is limited to the fees paid by that User for the last billing period, unless mandatory law provides otherwise. 4. The Provider's liability to consumer Users is limited to the fees paid by that User for the last three billing periods, unless mandatory law provides otherwise.
10. Duration and Termination
1. The agreement for the provision of Services by electronic means is concluded for an indefinite period upon Account creation or commencement of Service use. 2. The User may terminate Service use at any time. 3. The Provider may suspend or terminate access to the Account in case of material breach of these Terms, after prior notice to cease violations with a deadline of at least 7 days for remediation, provided the nature of the breach permits it. 4. The consequences of Account deletion, including data retention and deletion rules, are specified in the Privacy Policy.
11. Complaints
1. Complaints regarding the Services may be submitted to: support@lexense.ai. 2. A complaint should include at least: the User's contact details, a description of the problem, and the date the problem occurred. 3. Complaints are processed without undue delay, no later than 14 days from the date of receiving a complete submission.
12. Consumers and Entrepreneurs with Consumer Rights
1. The provisions of these Terms do not exclude or limit consumer rights arising from mandatory law. 2. In the event of conflict between the Terms and consumer protection regulations, the regulations shall prevail.
13. Changes to the Terms
1. The Provider may amend these Terms for valid reasons, in particular: changes in law, changes in Service functionality, changes in the business model or manner of Service provision. 2. Users will be notified of changes at least 14 days before they take effect, via the app, website, or email. 3. Continued use of the Services after changes take effect constitutes acceptance of the new version of the Terms, subject to consumer rights. A User who does not accept the changes may terminate Service use and delete their Account before the changes take effect.
14. Out-of-Court Dispute Resolution
1. Consumers may use out-of-court complaint and claim resolution methods, in particular: - via the Online Dispute Resolution (ODR) platform available at: https://ec.europa.eu/consumers/odr, - via the competent voivodeship Trade Inspection inspector, - via the permanent consumer arbitration court operating at the voivodeship Trade Inspection inspector. 2. Detailed information on out-of-court complaint and claim resolution methods is available on the Office of Competition and Consumer Protection website (https://www.uokik.gov.pl).
15. Governing Law and Final Provisions
1. These Terms are governed by Polish law, subject to mandatory consumer protection regulations. 2. If any provision of these Terms is found to be invalid, the remaining provisions shall remain in force. 3.
